As you recall, one of the two foster daughters Ted Klaudt conned into a rape scene filed suit (for “negligence, breach of fiduciary duty and battery”) against Klaudt and his wife, claiming that “Connie Klaudt knew about the abuse and did nothing to stop it.”

In response to the plaintiff’s complaint, Connie Klaudt asked a judge to dismiss the lawsuit because she had no responsibility over her husband and that the plaintiff could have stopped the sexual assaults.

In a cross-claim filed with the answer, Connie Klaudt also says that if the lawsuit is successful, her husband should have to pay all damages awarded.

Gee, Connie, isn’t a good Christian wife supposed to stick to her vows? Yeah, that “honor and obey” stuff, but we’re thinking specifically of that “for better or for worse” thing.

Tsk, tsk.

Victim Sues Ted Klaudt, Wife

More legal troubles for former South Dakota lawmaker Ted Klaudt. Now, one of the two foster daughters he was convicted of raping in a scheme over reproductive eggs, is suing him and his wife in federal court. According to court papers, Connie Klaudt knew about the abuse and did nothing to stop it.

We won’t disclose her name because she’s a rape victim. But according to these court papers she now lives in Mandan, North Dakota and says Klaudt tricked her so her consent wasn’t valid.

She also claims, that Klaudt’s extreme and outrageous behavior caused her mental and emotional distress and that procedure to harvest her eggs for women who could not conceive was really for Klaudt’s own sexual gratification.

The lawsuit also goes on to accuse, Connie Klaudt of knowing about the abuse but not doing anything about it.

It says she had a duty as a foster parent to provide a safe home environment that was free form sexual exploitation and assault.

Foster Child Sues Abusing Ex-Lawmaker

Connie Klaudt told the AP on Tuesday she had not been served with the complaint and did not have a lawyer.

“I cared for and loved all of my kids, including (the girl), just as if she was my own child. If she had come to me with any problem and told me, I would have taken care of it,” she said.

One of the girl’s lawyers, Michael Tobin of Sioux Falls, said he did not want to comment beyond the complaint.

The suit accuses the Klaudts of negligent infliction of emotional distress and breach of fiduciary duty. Ted Klaudt also is accused of battery, fraud, and intentional infliction of emotional distress, and his wife also is accused of negligence.

Convicted rapist and former state lawmaker Ted Klaudt filed appeal documents with the State Supreme Court.

Court documents filed Wednesday show Klaudt plans on appealing all four counts, judgments and convictions of second-degree rape charges. Klaudt, 49, was sentenced to 54 years in the state penitentiary after being convicted of raping two of his former foster daughters.

DEADWOOD — Ted Klaudt wiped tears away and apologized to his victims, the state legislature and the taxpayers of South Dakota as he was sentenced Tuesday in Deadwood to 10 years on each of two counts of tampering with witnesses.

Klaudt, 49, of Walker pleaded guilty in November to the two counts, admitting that he had told two of the teenagers he was charged with raping that if they did not tell law enforcement he would “forget about” money they owed him.

In exchange for his guilty plea on those counts, prosecutors dropped eight other counts including stalking and rape charges.

Patricia DeVaney, assistant South Dakota attorney general, said Klaudt also told the girls that if they told law enforcement he and his wife would lose their jobs and the girls would not be allowed to go home.

The counts of tampering with witnesses related to incidents that happened at Klaudt’s home in Corson County, which is in 4th Circuit Court. Lawrence County is also in the 4th Circuit which is why Klaudt was sentenced there.

The charges in both counties all stem from the same egg harvesting scheme Klaudt operated while at home and serving as a legislator in Pierre.

The scheme involved a 17-year-old girl and two women ages 18 and 19. Two of them were Klaudt’s foster daughters.

Klaudt was immediately remanded back into custody of the Lawrence County Sheriff for transport to the state penitentiary in Sioux Falls, where he will serve his sentence.

Well, that’s that — a fitting end to a sickening story of a disgusting human being. Chances are, the next time you read about Ted Klaudt in these pages, it will be his obituary — from behind bars.

In explaining why this might have happened, Ted Klaudt’s lawyer blamed, in part, the Internet. He says Klaudt’s obsession with inappropriate online material got him worked up enough to want to carry out the acts on actual people.

He asked the judge for just a four-year sentence, but that’s far from what Klaudt received.

His lawyer says at 600 pounds, for Ted Klaudt, just walking is a task of almost superhuman strength. Because of his health problems, a prison sentence of more than ten years, Tim Rensch argued, would be a death sentence.

The con started at his home in Walker, South Dakota and continued in Pierre. While Klaudt spent the day in the Capitol passing tougher laws for sex offenders, he spent the night in his motel room molesting his foster daughters.

There was never a legitimate egg donation business, but Klaudt still claims he had good intentions.

“His claim was that he was merely trying to do something to help these girls, which of course we think is ridiculous,” says Assistant Attorney General Patty DeVaney.

He apologized for what happened. But prosecutors don’t believe he’s sorry for what he did.

“We really have not seen an indication of true remorse,” DeVaney says. “Even more so than the lack of remorse is the continual denial of what actually happened here. Denial that there was anything criminal.”

That denial is what struck Judge James Anderson. For the blatant abuse of power as a foster parent and legislator, he handed down a 44-year sentence.

“He’s a sexual predator based on what we know from the investigation, and he’s going where he needs to be,” DeVaney says.

Klaudt’s sentence could be extended next week when he faces a judge in Deadwood on witness tampering charges. As it stands now, Klaudt won’t be eligible for parole until he’s 71 years old.

Klaudt’s lawyer, Tim Rensch of Rapid City, said such a lengthy sentence likely means Klaudt, who weighs more than 600 pounds and is in poor health, will never make it out of prison alive.

The defense attorney asked the judge to send Klaudt to prison for only four years because a longer sentence would amount to a life sentence. Klaudt could be rehabilitated and would never harm any other girls if released from prison, he said.

But Assistant Attorney General Patricia DeVaney, who prosecuted Klaudt, argued that he deserves a lengthy sentence because he violated the trust of his foster daughters and has never admitted that what he did was wrong.

“He’s still in a stage of denial … In his mind apparently he believes he was trying to help these girls,” DeVaney told the judge. “We have a sexual predator.”

Rensch said Klaudt wound up in trouble because he started to look at things on the Internet, including sex chat sites, he should not have been viewing.

Klaudt’s bulk does not excuse his actions, but helps explain his reaction to improper things he saw on the Internet, the defense lawyer said.

“His whole life he’s been a big guy … When you’re his size, you do your best to fit in,” Rensch said. “He really hasn’t been able to develop normally when we’re talking about sexual relationships or sexual desires.”

The defense lawyer said Klaudt should get credit for helping stranded travelers, giving a hand to poor people and serving on a church board.

Second Klaudt sentencing is delayed

The sentencing scheduled tomorrow in Deadwood for Ted Klaudt has been postponed. His lawyer says Klaudt is in a hospital for continuing medical treatment.

The former state lawmaker faces sentencing in Deadwood for witness tampering. Defense lawyer Tim Rensch says the sentencing has been rescheduled to January 22nd.

Klaudt also faces sentencing in Pierre on four counts of second-degree rape. That hearing also was postponed to January 17th after Klaudt went into a hospital last week. …

Rapid City lawmaker worried Ted Klaudt may die behind bars

State Sen. Bill Napoli, a longtime friend of Klaudt, said he was concerned the disgraced former lawmaker was in dire health. Napoli said Klaudt’s father died of a heart ailment at about the same age Klaudt is now.

He said the two men, both conservative Republicans who were allies in the Legislature, speak quite often. Napoli said the last time he asked Klaudt, he was told the former representative weighed 550 pounds.

Napoli said he fears Klaudt, who was convicted of molesting several young girls on Nov. 6, will die in prison. Napoli said he found Klaudt’s actions deplorable but is still concerned about his friend’s health. Between his family history of heart problems, his weight and the stress of the criminal case, he said Klaudt’s future appears dim. …

Claims to fame: Former South Dakota state representative; farmer; child rapist

Moral apex: Raped two of his foster daughters.

“The two girls,” reported AP, “testified that Klaudt touched their breasts and genitals as part of a phony scheme to help them make money by donating their reproductive eggs to infertile couples. The examinations occurred in Klaudt’s motel suite during the 2005 and 2006 sessions of the South Dakota Legislature.”

Klaudt sent some 70 bogus e-mail messages to one of the girls using the name “Terri Linee” — a fictitious representative of a fictitious agency promising payments of tens of thousands of dollars for the girl’s eggs.

The girl then testified that “Klaudt did up to ten examinations of her breasts and vaginal area, supposedly to see if she would qualify as an egg donor.”

What happened next: It took the jury just three hours to convict Klaudt on four counts of second-degree rape.

But, wait, there’s more: Klaudt also faced ten more charges of “rape and other offenses” in his home county — but plea-bargained out in order to avoid a second trial.

“The formal charges,” reported KSFY, included “4 counts of second-degree rape, 2 counts of sexual exploitation of a minor, 1 count of sexual contact with a child under the age of 16, 2 counts of witness tampering and 1 count of stalking.”

He pleaded guilty to the two counts of witness tampering, admitting that “he offered to forgive a debt if the mother of one of the foster daughters would call off an investigation of his actions. And in the earlier trial, one of the young women testified Klaudt had urged her to lie to authorities.”

Where he is now: Free on bond, awaiting sentencing (slated for January 4, 2008) on the rape convictions, and due for sentencing six days later for the witness-tampering charges.

He could get up to 100 years in prison — 25 years for each of the four counts of rape — plus another twenty years more on the latter charges. (If he had gone to trial for the ten counts of “rape and other offenses” in Corson County, he could have been racked up an additional 140 years in the pen.)

His lawyer says any decision to appeal the rape convictions will come after Klaudt is sentenced on all charges.

Ted Klaudt Hospitalized

Ted Klaudt faces up to 100 years in prison for raping two of his foster daughters in Hughes County. But his sentencing scheduled for tomorrow is now postponed.

The reason for the postponement is that Ted Klaudt was hospitalized earlier today.

The Corson County Sheriff says he was notified that Klaudt experienced chest pains, so a family member took him to the St. Alexius Medical Center in Bismarck, North Dakota. A Corson County ambulance was not needed.

. . .

The Attorney General’s office says there has not been a new date set yet for his sentencing in Pierre. Klaudt is also going to be sentenced in Deadwood next week on witness tampering charges, but so far there has not been a delay in that case.
